Good Point! It's also questionable that Obama will pick "a good" judge if by good one means independent of partisanship.So far, his picks have been big business friendly and can only be described as conservative.
Correction: replace "a good" with, "a decent" in the above comment.
AFAIK, Obama's SCOTUS picks have largely voted similarly to their predecessors, but per Glenn Greenwald's analysis on the picks, Kagan may be less reliable in that regard.But it will be a different matter if/when Obama gets to nominate a replacement from the five knee-jerk rightwing justices. Obama's defense of John Roberts should give one pause; he voted against Roberts only because he was advised of the political calculus.So, it's by no means certain that Obama would change the 5-4 imbalance of power, and regardless, hopes that he would do not justify, IMHO, stomaching his wrongdoing and his particular ability to drag the "left" into supporting it.
